1. Overview of Law Enforcement Requests
We are committed to supporting law enforcement in their efforts to protect the public and fulfill their responsibilities. We actively collaborate with law enforcement to mitigate threats of physical harm or misuse of our platform. This cooperation includes blocking and reporting any attempts to upload child sexual abuse material (CSAM) to xgigs.io, as well as contacting relevant law enforcement agencies when necessary, with legal counsel's guidance.
Due to various privacy laws, we generally cannot provide user data without a subpoena and typically cannot disclose the content of emails or other electronic communications without a court order or search warrant. We recommend reviewing the applicable laws before submitting any requests for customer information.
We aim to respond to valid law enforcement inquiries within fifteen (15) business days. However, some requests may require additional time for processing. If you are submitting an emergency request that needs immediate attention, please clearly explain the nature of the emergency and how the requested information will help address the situation.
We respond to requests from law enforcement officers to preserve user data while awaiting legal process. When submitting a preservation request, please include as many account identifiers as possible, such as a link to the advertisement, display name, account number, email address, legal name, and telephone number. For investigations related to credit card fraud, please provide the last four digits of the card, the cardholder's name, and details of specific transactions, including dates, times, and amounts.
2. Key Points Regarding Non-Law Enforcement Inquiries
We generally require a subpoena or court order before releasing user information to private parties. Additionally, we reserve the right to request further documentation from the requesting party, which may include authenticated copies of court pleadings, to ensure that the requested information is pertinent to any civil or administrative matter. Certain types of user data, such as stored messages, profile content, or information that reveals the content viewed by or the content creators subscribed to by a user, will only be disclosed in response to a court order that includes the necessary safeguards against unauthorized disclosure. 3. Contact Instructions
When requesting the disclosure of user information from us, please include the names of the user(s) involved, a description of the events related to the information being sought, and any other relevant details and legal documentation. Your request should be sent via email in our Contact us page.
For any email that includes a court order, search warrant, summons, subpoena, or other valid legal process, please use “LEGAL PROCESS” in the subject line. If your email pertains to an emergency situation involving suspected human trafficking, child exploitation, or any other emergency with an imminent risk to life, health, or safety, please use “EMERGENCY REQUEST” in the subject line.
Please note that nothing in this Policy shall be interpreted as a waiver or acceptance of formal legal process or consent to the jurisdiction of the courts and/or legal systems in any specific state, province, or country.
4. Retention of User Data
We do not guarantee the availability, accuracy, or consistency of our storage or backup services. Due to limitations in data storage capacity and security considerations, all content associated with our services, as well as any archival copies, may be deleted and destroyed at any time. Once this material is deleted, it is permanently and irretrievably lost, and recovery of such files is not possible under any circumstances. If we receive a legal preservation request from law enforcement, we will make every effort to preserve the data specified in that request, as required by applicable law.
5. Notification to Users
We reserve the right, but are not obligated, to notify the affected customer before responding to a civil or administrative subpoena. We may also delay compliance for up to ten (10) calendar days to allow the customer the opportunity to challenge the subpoena or obtain a protective order from a competent court, except in emergency situations or where prohibited by law. Typically, we do not inform users about criminal investigations. This Policy does not constitute legal advice; please consult your own legal counsel for any legal inquiries.
6. Disclosure of User Data in Other Situations
Despite the information provided above, we reserve the right to disclose customer data when we reasonably believe it is appropriate to do so, based on our sole discretion. Such situations may include, but are not limited to:
Fulfilling any legal requirement
Identifying, contacting, or taking legal action against someone who may be violating any of the user agreements and/or policies governing access to or use of our services
Investigating fraud or deceptive activities
Maintaining the security of our systems, servers, data centers, or properties
Ensuring the proper operation of our services
Protecting ourselves, our customers, and the general public
Nothing in this document is intended to create a legal obligation regarding the preservation or disclosure of user data where such an obligation does not already exist.
